Transit visa requirement in Frankfurt, Germany

My wife is travelling from Chicago  To Chennai by 
Air-India with a 90 minutes stop over at Frankfurt.
There is no change of flight at Frankfurt but only 
a brief stop over there.

As many of you would know, any traveller touching 
Frankfurt needs an airport transit visa even if he 
stays within the airport. This visa is issued to 
Indian nationals if he carries a valid US visa in 
Frankfurt airport itself. (Otherwise he has to get 
it from the German consulate).

My wife is in legal status in US but her H1 visa 
stamping has expired. 

Is there anyone who was able to get the airport 
transit visa at Frankfurt with an expired H1 visa 
but with legal status?

I would appreciate any info on this issue.
